Whenever people file for bankruptcy, whether Chapter 13 or Chapter 7, they will have to pay fees to the court. Generally speaking, the fees include a $245 case filing fee, a $39 miscellaneous administrative fee, and a $15 trustee surcharge.
People will pay their fees directly to the clerk of the court upon filing. In cases where people cannot afford the fees right away, they may make installments with the court's permission. However, the number of installments people can make is limited to four in the final installment is due no later than 120 days after the bankruptcy petition has been filed.
If people need to file a joint bankruptcy petition, they will only have to pay one filing fee, one administrative fee, and one trustee surcharge. Anytime people fail to pay the required fees their cases may be dismissed by the bankruptcy court.
