Pre-Chapter 7 Bankruptcy Filing Information

To begin, you will be asked to fill out certain paperwork associated with Chapter 7 filings and sign a petition. The purpose of the petition is to verify that all of the information that was given to your lawyer and outlined in the petition is correct. When you sign this official document your lawyer will then have it filed in the court system.

You could then be required to attend a "341 hearing" with your attorney, creditors, and a trustee appointed by the court. While this is not required of everyone, you should be prepared for it regardless. It usually takes about five minutes or so.
