Homeowner in the Military Fights Foreclosure
After finding himself kicked out of his own home, Texas Army National Guard Sergeant Jorge Rodriguez decided to take action against the bank.
As Rodriguez was preparing to deploy for Iraq in 2006, he didn't know that CitiMortgage was going to foreclose on his home. It was only upon returning to the states 11 months later that Rodriguez learned about the foreclosure.
After speaking with his attorney about the bank's action, he learned that it violated a federal law passed in 2003 that is designed specifically for active service members. Since Rodriguez was in training at Fort Hood and on communication lock down at the time, Rodriguez would not have been able to know about the foreclosure until communications were restored.
When he did come back from Iraq, Rodriguez was horrified to discover that his house had been sold for $137,900. Furthermore, he did not receive any of the sale proceeds, even though the property sold for $13,400 more than the original mortgage was worth.
